Delivery driver for age discrimination after losing job

LUFKIN - A former deliveryman has filed a discrimination lawsuit that argues he was terminated due to his age.

George Lloyd filed the lawsuit against The Made-Rite Co. on Dec. 17 in Nacogdoches County Court. The defendant removed the case to the Eastern District of Texas, Lufkin Division on Jan. 10.

Lloyd alleges that he was subjected to derogatory comments regarding his age by his supervisor.

According to the complaint, in the fall of 2009 Lloyd needed to take time off due to medical conditions. During his leave, the supervisor terminated Lloyd allegedly for an unreported incident involving the company's delivery truck. At the time of his termination, Lloyd was 56 years old.

Made-Rite Co. is accused of negligence in hiring, supervising, training and retaining its employees, failing to properly screen, evaluate and investigate whether its employees are unfit or incompetent and failing to take supervise and train its employees.

The defendant is accused of violating the Age Discrimination in Employment Act and the Family and Medical Leave Act, intentional infliction of emotional distress and negligence.

The plaintiff is seeking an award of damages, court costs, and interest.

Lloyd is acting as his own attorney. He has requested a jury trial.

U.S. District Judge Marcia A. Crone is assigned to the case.
