Worker claims he was doused with chemicals

GALVESTON - Claiming he was doused with chemicals while working last year, Sergio Padilla of Houston is suing APS Anzualda Professional Services.

Padilla says APS owned a piece of equipment which broke and spewed chemicals onto his clothing, a lawsuit filed Jan. 18 in Galveston County District Court explains.

The plaintiff was using the equipment to clean various chemical tanks for his employer, Delasco, at a local plant. He informed the defendant's employees about the alleged malfunction.

"When the plaintiff informed the defendant's employees that the equipment is broken, they attempted to repair it and told him that the liquid inside the equipment would cause him no harm," the original petition says.

Padilla adds that he did not know the liquid which leaked all over him was a chemical that eventually burned his thighs and genital area. He insists he did nothing to cause the alleged incident.

Consequently, he seeks unspecified monetary damages.

Delasco is not a defendant in the suit.

Attorney Kerry M. Guidry of Houston is representing Padilla, and Galveston County 10th District Court Judge David Garner is presiding over the case.
