GALVESTON - Lillie M. Alexander has filed a $400,000 lawsuit against Robert L. Moody Sr. of Galveston claiming she hurt herself at his residence.
According to recent court documents, Alexander fell and injured her femur bone in Moody's backyard on June 1, 2009.
Her suit was filed Jan. 20 in Galveston County District Court.
Alexander worked as a nurse for Ann Moody, the defendant's spouse, for seven years. Even though the plaintiff's journey through the backyard was not part of her regular duties, she had been instructed by her employer to do so, the original petition says.
The plaintiff claims that trash in the backyard exacerbated her alleged fall.
"The plaintiff contends that the negligence of the defendants is seen by the failure to insure that the premises was free of defects to prevent injuries," the suit says.
It ultimately explains that the defendant informed Alexander she would be taken care of medically at the time of her injury, however, the complainant subsequently learned there was no workers compensation and her bills had been covered by Medicare.
She is represented by attorney Anthony P. Griffin of Galveston.
Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
