Lindale company accused of not paying supervisors overtime pay

MARSHALL - A supervisor for a Lindale company has filed a collective lawsuit that accuses his employer of failing to pay the supervisors overtime wages.

Stephan Arterberry filed suit against Express Energy Services Operating on Jan. 31 in the Eastern District of Texas, Marshall Division.

Arterberry began his employment as a safety supervisor at the Express facility in Lindale. According to his allegations, Aterberry was not paid overtime wages for hours worked in excess of 40 hours in a work week. He states his actual job responsibilities did not classify him as an exempt employee.

The lawsuit is a collective action, seeking to represent numerous safety supervisors who were not paid for all overtime hours.

The defendant is accused of violating the Fair Labor Standards Act.
Individually and on behalf of the other safety supervisors, the plaintiff is seeking damages for unpaid wages, liquidated damages, court costs and attorneys' fees.

Arterberry is represented by Tyler attorney William S. Hommel Jr.

A jury trial is requested.

U.S. District Judge T. John Ward is assigned to the case.
