Cyclist sues TXDoT, says construction caused bike flip

GALVESTON - Daniel Valdez is suing Angel Brother Enterprises Ltd. and the Texas Department of Transportation over an accident he insists was caused by roadwork.

Valdez claims he was injujred on Oct. 16, 2010, when the front tire of his bicycle dropped because of an elevation change in the pavement work performed by the TXDot at the intersection of 51st Street and Broadway in Galveston.

The suit was filed Feb. 9 in Galveston County District Court.

"The incident caused the plaintiff to flip off his bike, causing serious injury," the original petition says.

Valdez blames the defendants for not warning the public of a dangerous condition upon the roadway and not maintaining said roadway in a reasonably safe manner. He argues that he did nothing to bring forth the alleged incident.

The plaintiff consequently seeks unspecified monetary damages.

He is represented by Matthews and Forester.

The case has been assigned to Galveston County 405th District Court Judge Wayne Mallia.
