Company faces personal injury lawsuit after employee assaults woman

TYLER - A Dallas company is being sued after a female employee assaulted another woman.

Pam Atkins filed suit against WFC Limited Partnership, doing business as World Finance Corp., and Zanobia Jones on Jan. 19 in the 123rd Judicial District Court of Panola County. The defendant removed the case on Feb. 11 to the Eastern District of Texas, Tyler Division.

Atkins states she was assaulted by Jones on May 12, 2009. She argues that at the time of the incident, Jones was acting within the course and scope of her employment for defendant World Finance Corp., making the company vicariously liable for the conduct of their employee under the doctrine of respondeat superior.

Asking for an award of punitive damages, Atkins claims that the assault by Jones was done intentionally and knowingly.

The plaintiff is asking the Court for an award of compensatory damages, medical expenses, physical impairment, physical pain, mental anguish, physical disfigurement, interest, court costs and attorney's fees.

Atkins is represented by Joe B. Young of Patton, Nix & Young in Longview.

A jury trial is requested.
