Southern County Mutual sued for not paying underinsured motorist claim

In September 2009, Royce and Laura McClure were injured in an automobile collision caused by an uninsured driver. To date, the couple alleges their insurance company refuses to pay benefits for the incident.

On Feb. 11 the couple filed suit against Southern County Mutual Insurance in Jefferson County District Court, alleging the company refuses to honor its policy.

Court records show that on Sept. 5, 2009, the McClures were traveling on Highway 365 in Port Arthur when another motorist by the name of Tory Frasier had a seizure and crossed into the couple's lane of traffic, striking and injuring them.

The McClures submitted a claim to Southern Mutual for benefits under the uninsured motorist section of their policy.

"Plaintiffs filed their claim for personal injury protection and underinsured motorist protection benefits," the suit states. "Defendant has failed and refused to respond to the claim."

The couple seeks to recover actual damages and all court costs.

Beaumont attorney Brandon Monk represents them.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
