A Jefferson County woman has filed suit against the driver who she claims struck her as she was walking down the street a liquified natural gas facility.
Susan Limbrick claims defendant Stephen Shelby was driving a truck for defendant Chicago Bridge and Iron on Dec. 12 at the LNG plant when he struck Limbrick.
Because of the incident, Limbrick incurred medical costs, experienced physical pain and suffering and sustained mental anguish, according to the complaint filed March 1 in Jefferson County District Court. In addition, she suffered physical impairment and lost wages, the suit states.
Shelby negligently failed to maintain a proper lookout, failed to timely apply his brakes, failed to yield, failed to maintain a proper distance and failed to sound his horn, the complaint says. In addition, he failed to control his speed, Limbrick claims.
In her complaint, Shelby is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.
She will be represented by John S. Morgan of Harris, Duesler and Hatfield in Beaumont.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
