Galveston condo owners sue property manager over unresolved Ike damages

GALVESTON – Claiming there are still unresolved problems from damage to their units from Hurricane Ike in 2008, a group of Galveston residents have filed suit against Harbor East Condominiums Inc. and property manager L. Don Buss.

A lawsuit filed Feb. 18 in Galveston County District Court faults the defendants for committing negligence and breach of fiduciary duty.

Ike, a Category 2 storm, made landfall on Galveston's East End on Sept. 13, 2008, significantly damaging the interior, exterior and the roof of the buildings which comprised the Harbor East Condominiums.

The complainants say that the defendants failed to properly and timely file all necessary proof of loss and claims under the insurance policies covering the property as well as mishandled insurance proceeds that were received. They also criticized defendant Buss's work performance.

Consequently, the plaintiffs seek unspecified monetary damages and a jury trial.

They are represented by attorney Craig Eiland of Galveston.

The case has been assigned to Galveston County 56th District Court Judge Lonnie Cox.
