GALVESTON � Claiming it received defective liners, ISP Technologies Inc. is seeking around $280,000 in damages from Next Generation Films Inc.

In a lawsuit filed March 1 in Galveston County District Court, ISP alleges it purchased liners with a broken seal from Next Generation.

ISP bought the packaging products to ship pharmaceutical chemicals. The alleged defect left the chemicals open to potential contamination, the original petition says.

The plaintiff insists it "acted responsibly and swiftly" upon discovery of the defective liners by quarantining the suspect lots, recalling certain shipments and repackaging its products with non-defective liners.

"All of (that) was done in an effort to mitigate any potential damages due to the defective liners, and ensure the safety of its products for the ultimate consumer," the suit says.

In addition to monetary damages, a jury trial is sought.

Attorney Raymond A. Neuer is representing the plaintiff, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
