Driver's failure to yield blamed for collision

A Port Arthur woman has filed suit against the driver who she claims failed to yield the right-of-way and struck her vehicle.

Andrea Denise Jones claims she was driving in Jefferson County on Sept. 2 when the collision occurred after defendant Johnnie Johnson failed to control his speed, failed to keep a proper lookout and failed to yield the right-of-way.

Because of the collision, Jones incurred medical costs, experienced physical pain and mental anguish and lost earnings, according to the complaint filed March 3 in Jefferson County District Court. In addition, Jones suffered damage to her earning capacity, experienced disfigurement and physical impairment and incurred property damages, the suit states.

Johnson negligently failed to control her speed, failed to maintain a proper lookout, failed to timely apply his brakes, failed to drive in a safe manner, failed to maintain control of his vehicle and failed to yield the right-of-way, the complaint says.

In her complaint, Johnson is seeking actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Matthew C. Matheny of Provost and Umphrey Law Firm in Beaumont will be representing her.

The case has been assigned to Judge Bob Wortham, 58th District Court.
