Suit alleges company owes $230K for post-hurricane services

GALVESTON � SM Partners LLC has filed suit against Northwest Bay Investments LLC in an effort to recover approximately $230,000 for post-Hurricane Ike services.

According to a lawsuit filed March 10 in Galveston County District Court, NBI owes SM Partners $232,672 for restoration work performed on its Galveston property from September 2008 to January 2009.

The plaintiff provided labor and materials and originally invoiced NBI for $172,990 at the beginning of 2009, the suit says.

It adds "despite SM Partners' performance and demand for payment, however, NBI has failed and refused and continues to fail and refuse to pay for the materials and services furnished to the property by SM Partners."

The original petition further explains that the contract between the two parties "provides that balances over thirty (30) days past due shall bear simple interest at the right of 1.5 percent per month," resulting in a charge of $2,594.86 per month for every month the balance is past due.

"To date, NWI's balance is 23 months past due," it says.

Adams and Reese LLP is representing the plaintiff, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
