Vehicle backing out of driveway blamed for crash

A Jefferson County woman says she sustained physical pain and suffering after a driver backed out of a driveway and struck her vehicle.

Cullen Cannon filed a lawsuit March 14 in Jefferson County District Court against Nikki N. Weaver.

Cannon claims Weaver struck her vehicle after failing to yield the right-of-way as Weaver backed out of a driveway on Feb. 1, 2010.

Although Cannon does not specify where the collision occurred, she does say she incurred medical costs because of it. In addition, Cannon suffered mental anguish, physical impairment and disfigurement; lost wages; and lost her earning capacity, according to the complaint.

She blames Weaver for causing the collision, saying Weaver negligently failed to maintain a proper lookout, failed to timely apply her brakes, failed to yield, failed to maintain a proper distance and failed to turn her vehicle to avoid a collision.

In her complaint, Cannon seeks an unspecified judgment, plus interest, costs and other relief the court deems just.

John S. Morgan of Harris, Duesler and Hatfield in Beaumont will be representing her.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
