Worker who fell off ladder sues employer for not providing safety equipment

MARSHALL - After falling off a ladder, a worker is suing his employer for not providing necessary safety equipment.

Joel Lopez filed suit against Pilgrim's Pride Corp. and Kaiser Contract Cleaning on March 21 in the Eastern District of Texas, Marshall Division.

According to court records, Lopez was working for Kaiser Contract Cleaning, doing sanitation work at Pilgrim's Pride on March 4 when he fell off a ladder.

The defendants are accused of failing to properly operate and maintain their equipment, failing to properly train and supervise its employees and failing to provide adequate safety wear to its employees.

Lopez claims he has been unable to return to work despite rehabilitation, according to the suit.

He is seeking damages for medical expenses, extreme pain and suffering, loss of past earnings, loss of earning capacity, physical impairment, disfigurement, mental anguish, interest and court costs.

Lopez is represented by Reese P. Andrews of Andrews & Andrews in Nacogdoches.

A jury trial is requested.
