Colorado woman sues over Texas vehicle collision

TYLER - A Colorado woman is suing a Utah man for causing a motor vehicle wreck in Texas in which she was injured.

Pamela Flynn filed suit against Werner Enterprises Inc. and Larry Pascal Lewis on Feb. 15 in the Gregg County Court. The defendant removed the case to the Eastern District of Texas, Tyler Division on March 29.

According to court documents, Flynn was a passenger in a vehicle that was involved in a collision with a vehicle operated by defendant Larry Pascal on March 24, 2009. Flynn accuses Pascal of negligent actions which caused the collision.

The Colorado resident argues defendant Werner Enterprises is vicariously liable under the theory of respondent superior for the actions of Lewis, one of Werner's employees.

The plaintiff is seeking damages for medical expenses, physical pain, mental anguish and suffering, physical impairment, interest and court costs.

Flynn is represented by Baytown attorney Scott C. Lannie.

U.S. District Judge Michael H. Schneider is assigned to the case.
