MARSHALL - A trucking company is facing a lawsuit asking for more than $75,000 regarding a motor vehicle collision that occurred on US Hwy 69 in Smith County.
Julie Anna Benson filed suit against Dart Transit Co., doing business as Advantage Transportation Inc. and Paul Marvin Henely on March 31 in the Eastern District of Texas, Marshall Division.
According to the lawsuit, the accident occurred on Dec. 3, 2010, on U.S. 69 in Tyler when defendant Paul Marvin Henely collided with a vehicle operated by Benson. Benson states that Henely's failure to use ordinary care caused the wreck.
The defendants are accused of negligence and negligence per se.
The plaintiff is seeking damages for physical pain, mental anguish, loss of earnings or earning capacity, physical and mental impairment, medical expenses and attorney's fees.
A jury trial is requested.
