SHERMAN - A former Grayson County Deputy Clerk is suing the county after she was terminated shortly after a new District Clerk was sworn into office.
Claiming racial discrimination, Gina Delphin filed suit against Grayson County on April 8 in the Eastern District of Texas, Sherman Division.
Delphin began working for the County as a full-time employee in October 1989 and was terminated in October 2010. At the time of the termination, Delphin was employed as a deputy clerk in the Grayson County District Clerk's Office and was responsible for filings in the 397th Judicial District Court.
The former deputy clerk states that shortly after District Clerk Kelly Ashmore was sworn into office, Delphin was terminated.
According to the lawsuit, Ashmore asked the plaintiff why she had not "contacted" her following the election. Delphin explained that she never contacted an elected official who was coming into office.
"Then Ms. Ashmore told Plaintiff she did not think they could work together so she no longer needed Plaintiff's services," the lawsuit states.
Delphin argues that white or non-Hispanic employees who did not contact Ashmore following the election were not fired.
The defendant is accused of failing to protect the plaintiff from discrimination in the workplace on the basis of national origin and for violations of Delphin's civil rights.
The plaintiff is seeking an award of damages for mental anguish, punitive damages, attorney's fees, court costs and interest.
Delphin is represented by Sherman attorney Ronald R. Huff.
A jury trial is requested.
U.S. District Judge Richard A. Schell is assigned to the case.
