Insurer sues to recover payout for car crash

An insurance company seeks to recover money it paid to a Beaumont man following a car collision.

Allstate Insurance Co. filed a lawsuit April 18 in Jefferson County District Court against Charles Anyichie.

Allstate claims one of its insureds, James McIntosh, drove north in the 1000 block of Ninth Street at its intersection with Ashley Street in Beaumont on Oct. 8 when Anyichie, who approached the intersection at Ninth Street, struck McIntosh's vehicle.

Because of the collision, Allstate paid McIntosh for damages he sustained, according to the complaint.

It blames Anyichie for causing the collision, saying he negligently failed to control his speed, failed to keep a proper lookout, failed to stop at a stop sign and failed to yield the right-of-way.

In its complaint, Allstate seeks unspecified damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Thomas E. Quirk of the Law Offices of Aaron and Quirk in San Antonio will be representing it.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
