MARSHALL - A Wal-Mart shopper is suing the store for not barricading a spill after she slipped in liquid and fell under a bench.
Ora Relerford filed suit against Wal-Mart Stores Inc. on April 20 in the Eastern District of Texas, Marshall Division.
According to the lawsuit, Relerford was in the process of purchasing a money order at the Wal-Mart service desk, turned around to sit down on the bench located near the service desk, slipped in a liquid substance on the floor and fell under the bench.
Relerford states she was severely injured in the incident and accuses the defendant of creating a dangerous condition by failing to place warning signs or barricades near the substance
The defendant is accused of failing to provide a safe pathway, creating and failing to warn a dangerous and unsafe condition, failing to warn of the potential hazards of walking in the area of the premises, failing to properly clean, inspect or maintain the pathway, failing to properly train and supervise its employees in the proper maintenance of the pathway and failing to enforce safety instructions.
The plaintiff is seeking damages for medical expenses, physical pain and mental anguish, physical disfigurement, physical impairment, court costs and interest.

A jury trial is requested.
U.S. District Judge David Folsom is assigned to the case.
