Wrongful death lawsuit filed over tractor-trailer collision

TEXARKANA, Texas - A wrongful death lawsuit has been filed over a deadly tractor-trailer collision in Arkansas.

Lynette Faulkner, individually and as the administrator of the estate of Timothy Alan Faulkner, deceased, filed suit against J.D. & Billy Hines Trucking Inc. and Charles Gwin on April 20 in the Eastern District of Texas, Texarkana Division.

The crash occurred on Feb. 21 as Timothy Faulkner was driving a 2006 Mack diesel tractor truck with a trailer on U.S. Highway 371 near Prescott, Ark. Defendant Charles Gwin was operating a 2009 Freightliner diesel tractor truck and collided into Faulkner's truck. Faulkner received fatal injuries in the accident.

The defendants are accused of failing to keep a proper lookout, failing to apply brakes, failing to take proper evasive action, failing to maintain the proper lane of traffic, failing to yield the right of way, driver inattention, failing to drive at a safe speed and for operating the tractor-trailer in violation of applicable statutory regulations.

The plaintiff is seeking wrongful death damages, survival damages, interest and court costs.

Faulkner is represented by R. Wesley Tidwell and Edward D. Ellis of Ellis & Tidwell in Paris, Texas.

U.S. District Judge David Folsom is assigned to the case.
