Woman sues remodelers over fall at her home

GALVESTON � A Texas City woman claims a remodeling company created a hazardous condition in her home which caused her to fall and break her leg.

Susan Evans filed a lawsuit against Heavenly Lane Construction LLC on April 20 in Galveston County District Court.

"Susan Evans's bodily injuries occurred as a direct result of a fall that was proximately caused by the dangerous condition... which the defendant knew or, in the exercise of ordinary care, should have known existed," the original petition says.

"The defendant's agents, servants and employees negligently permitted the condition of the premises to become a hazard to the plaintiff, negligently or willfully allowed such condition to continue and negligently or willfully failed to warn the plaintiff of the condition."

Heavenly Lane Construction is faulted for failing to give warnings to the plaintiff of the unsafe condition, failing to remove the unsafe condition causing the slip and fall and failing to discover and remove the unsafe condition within a reasonable time.

Consequently, Evans sues for physical pain and suffering, mental anguish and medical expenses.

The case has been assigned to Galveston County 405th District Court Judge Wayne Mallia.
