Cheddar's non-suited from slip-and-fall litigation

Cheddar's Casual Cafe was recently non-suited from a slip and fall lawsuit filed last October.

As previously reported, Gloria Wilson filed suit against Cheddar's on Oct. 21 in Jefferson County District Court, alleging she slipped and fell upon entering the Beaumont restaurant.

On March 4 Wilson filed a motion for non-suit, stating she no longer wished to pursue her claims against Cheddar's.

Judge Bob Wortham, 58th District Court, granted the motion on March 14, dismissing the restaurant chain with prejudice, court papers say.

Wow Food Concepts, a company later added as a defendant, is still a defendant in the lawsuit.

According to the lawsuit, on May 17, 2009, Wilson entered the restaurant and "suffered serious injuries as a result of a dangerous condition that caused (her) to slip and fall."

In her suit, Wilson alleges the defendants "negligently allowed the floor to become slick" and failed to warn her of the hazard.

Provost Umphrey attorney Ryan Schaper represents the plaintiff.

Cheddar's was represented in part by Houston attorney David Klosterboer.
