GALVESTON � Galveston County resident Melvin Green he got into a wreck because a truck belonging to Cleanserve Inc. was parked on the shoulder of the highway and blocked his view.
A lawsuit filed May 9 in Galveston County Court at Law No. 3 says Green, 54, collided with the Cleanserve truck along Highway 146 on Aug. 20, 2010.
The plaintiff was riding his motorcycle northbound in the outside lane and in the process of turning into a private parking lot at the time of the incident.
"A vehicle pulled out and Melvin Green took evasive action, but collided with the vehicle that pulled onto the roadway," the original petition says.
"The defendant, Cleanserve, Inc., had a truck unnecessarily parked on the shoulder and said truck was obstructing the view of Melvin Green and of the other vehicle that pulled onto the roadway."
The suit faults the defendant for failing to park in a safe area and failing to adequately mark the vehicle's existence to warn the driving public.
Green insists that he experienced physical pain and suffering, mental anguish, physical impairment, disfigurement and losses of household services, earning capacity and wages as a result of the collision in question.
Consequently, he seeks unspecified monetary damages.
