DeQueen Elementary School, Port Arthur
The Port Arthur Independent School District has filed suit against Berridge Manufacturing for allegedly refusing to repair a leaking campus roof.
The suit was filed May 18 in Jefferson County District Court.
According to the lawsuit, PAISD obtained a new roof at the DeQueen Elementary School in August 2006. The roof, which was warranted by Berridge, began leaking in November 2008.
PAISD submitted a claim on Jan. 19, 2009, and an agreement on what action Berridge needed to take was reached on July 26, 2010.
However, Berridge "has wholly failed to comply with the settlement agreement and no action has been taken," the suit states.
The suit alleges the defendant breached its contract.
PAISD is suing for actual damages and all court costs, including attorney's fees.
Beaumont attorney Melody Chappell of Wells, Peyton, Greenberg & Hunt represents the district.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
