Beaumont woman sues after breaking hip in fall at Sam's Club

A Beaumont woman has filed a personal injury lawsuit against Wal-Mart after she allegedly tripped on a floor display and fell.

Patricia Morrison filed suit against Wal-Mart Stores Inc., doing business as Sams Wholesale Club, on Jan. 19 in Jefferson County. The defendant removed the case to the Eastern District of Texas, Beaumont Division on May 16.

The incident occurred on Jan. 19 as Morrison was shopping at a Sam's Wholesale Club in Beaumont. Morrison states she tripped and fell over a poorly placed floor display. According to the lawsuit, the accident caused Morrison to break her hip/femur.

The defendant is accused of negligence for the placement of the display case in a manner that a person would likely trip over it, failing to properly maintain the display so it was not a tripping hazard, failing to provide adequate warning signs or barriers warning of the hazard, failing to inspect the premises and failing to remedy a dangerous condition.

The plaintiff is seeking damages for medical expenses, physical impairment, physical pain and mental anguish, physical disfigurement, interest and court costs.

Morrison is represented by J. Trenton Bond and Chris Portner of Portner Bond in Beaumont.

U.S. District Judge Marcia A. Crone is assigned to the case.
