62-year-old employee files age discrimination lawsuit after losing job

TYLER - After losing his job, a 62-year-old healthcare employee has filed a lawsuit claiming he was terminated because of his age.

Claiming violations of the Fair Labor Standards Act, Dewey Humphries filed suit against Murphy Healthcare III, also known as Frankston Healthcare Center, on June 22 in the Eastern District of Texas, Tyler Division.

According to the complaint, Humphries went to work for defendant Murphy Healthcare in February 2008 and had been employed by the same facility since 1994. He was terminated from the facility in April 2010.

Humphries states he was terminated because of his age and was replaced by a younger employee who was not as qualified.

The plaintiff is seeking damages for back pay, front pay, value of fringe benefits, reinstatement, liquidated damages, attorney fees and interest.

Humphries is represented by Tyler attorney Bob Whitehurst.

A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
