Couple sues woman who ran over son

GALVESTON - Luciana Rubio and Felipe Rubio Martinez allege that Alma Delia Solis-Espinosa ran their minor son over two years ago, recent court documents say.

A lawsuit filed June 20 in Galveston County Court at Law No. 2 says Solis-Espinosa hit the child with her 1995 Chevrolet Suburban in front of a Dickinson mobile home park and dragged him "for an undetermined distance" on June 21, 2009.

The original petition shows plaintiffs' son was crossing the driveway of the mobile home park in the 3620 block of FM 1266 when the incident "suddenly, unexpectedly and without warning" occurred.

It further explains that the child's entire body "was pulled under the defendant's vehicle, dragged and ultimately pushed out on the passenger's side near the vehicle's rear wheel/tire."

Solis-Espinosa is blamed for failing to keep a proper lookout, failing to properly and timely apply his brakes and failing to take other appropriate corrective action to avoid the collision in question.

She is also faulted for reckless conduct and gross negligence.

Consequently, the complainants sue for physical pain and suffering, physical impairment, mental anguish and other damages.

They are represented by The Law Offices of Manuel E. Solis Jr.

The case has been assigned to Galveston County Court at Law No. 2 Judge Barbara Roberts.
