Two Port Arthur residents incurred medical costs when a driver rear-ended them, according to recently filed court documents.
Johnny and Donna Tatmon filed a lawsuit June 28 in Jefferson County District Court against Patricia Bedyneck and Savant's Collision Center.
In their complaint, the Tatmons allege Johnny Tatmon drove in the left lane of the Martin Luther King Jr. Parkway when he slowed due to a road barricade, according to the complaint. Suddenly, Bedyneck, who drove a vehicle for Savant's, failed to control her speed and rear-ended the Tatmons' vehicle, the suit states.
Because of the collision, the Tatmons incurred medical costs, lost their earnings and their earning capacity and sustained physical impairment, physical pain and mental anguish, the complaint says.
The Tatmons blame Bedyneck for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to control her speed and failed to maintain a safe distance between her vehicle and theirs.
In their complaint, the Tatmons seek an unspecified judgment, plus pre-judgment interest, costs and other relief to which they may be entitled.
Jonathan C. Juhan of Beaumont will be representing them.
Judge Bob Wortham, 36th District Court, has been assigned to the case.
