Failure to control speed blamed for crash on Eastex Freeway

An Orange County man has filed suit against the driver who he claims rear-ended his vehicle.

Travis Dyson claims he was driving on Eastex Freeway in Beaumont on Oct. 10, 2009, when Brett Baker, who was driving a vehicle for Shane Transportation in the same direction, failed to control his speed and rear-ended Dyson.

Because of the collision, Dyson incurred medical costs, lost earnings and his earning capacity and experienced physical impairment, physical pain, mental anguish and disfigurement, according to the complaint filed July 5 in Jefferson County District Court.

Baker negligently failed to keep a proper lookout, failed to timely apply his brakes, failed to control his speed and failed to maintain a safe distance, the suit states.

In his complaint, Dyson is seeking an unspecified judgment, plus pre-judgment interest and other relief the court deems just.

Jonathan C. Juhan of Beaumont will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.
