Atwood obtains default judgment in boat suit

Marvin Atwood and his company Home Energy Conservations obtained a default judgment against Jeff Williams, who allegedly stole $10,000 from Atwood.

Atwood, also the owner of Starvin Marvin's Bar and Grill, has a separate suit against the city of Beaumont, in which he seeks a permanent injunction against a noise ordinance which would stop the bar from hosting live music on its patio.

Atwood filed suit against Williams on April 5 in Jefferson County District Court, alleging Williams cashed a $10,000 check from Atwood but failed to install a new engine in his boat.

Court records show Atwood hired Williams in November 2009 to make certain repairs on the boat, including purchasing and installing a new engine.

On July 12 Atwood filed a motion for entry of default judgment, arguing that more than 30 days had elapsed since Williams was served with the lawsuit.

Judge Milton Shuffield, 136th District Court, granted the motion on Monday, July 18.

A court official told the Southeast Texas Record that a dollar amount of the default judgment had not been entered into the record yet.
