Plaintiffs receive $55K in suit against day care center

GALVESTON - The parties in a Galveston County couple's personal injury lawsuit recently reached an agreed settlement.

Court documents filed June 10 in the Galveston County 212th District Court show plaintiffs Frank and Edith Reyes, defendants Kid City Childcare Learning and Sports Center LLC and Lindsay Sweatt and their respective counsels consented to $55,000 being awarded to the plaintiffs.

The move ends the Reyes' lawsuit, which was entered Oct. 9, 2009, before the same court.

The couple claims the respondents neglected to tend to their then-1-year-old son after he fractured his leg two months prior, alleging Sweatt pushed the child through a doorway.

According to the suit, the defendants ignored the boy after the alleged incident for the rest of the day.

Kid City and Sweatt are blamed for failing to use adequate care in transporting their son, failing to maintain a safe day care area and failing to render aid and otherwise attend to the boy's injuries in any fashion -- let alone a timely fashion.

The defendants each submitted their original answers a month after learning about the suit.

A breakdown of the settlement indicates a majority of the funds going toward the use and benefit of the toddler.
