GALVESTON - After she was reportedly hurt while helping dock a boat belonging to Happy Hen Egg Farms Inc., Fort Bend County resident Shari Lynn Peterson has filed a lawsuit.
Recent court documents filed July 11 in Galveston County District Court show Peterson followed captain and master Delbert Brod Jr.'s instructions with bringing the M/V Happy Hen Farms to port the night of May 29, 2010, when she sustained severe, disabling and permanent injuries.
Brod is also a defendant in the case.
The plaintiff was among several individuals who rode the Happy Hen Farms, a 37.7-foot motor vessel, as part of a voyage and excursion.
According to the original petition, she remained on the respondent's watercraft while the other passengers disembarked upon nightfall, returning to the Marina Bay Harbor Yacht Club shortly afterwards.
It further explains that Brod instructed Peterson to assist him in docking the Happy Hen Farms at the marina.
"Specifically, the defendant Delbert Brod Jr. instructed the plaintiff to act as a deckhand and line handler in docking the M/V Happy Hen Farms at the marina and, in that regard, instructed the plaintiff to jump from the bow of the M/V Happy Hen Farms onto the dock in order to moor the vessel to the dock," the suit says.
The complaint does not elaborate on the extent of Peterson's injuries.
She seeks unspecified monetary damages and a jury trial.
Reed & Terry LLP is representing the plaintiff, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
