SembCorp-Sabine Shipyard has dismissed KTM Services from a breach of contract suit filed in March.
As previously reported, SembCorp filed suit against KTM Services on March 24 in Jefferson County District Court, alleging the company owes $165,000 in past due rent.
On July 25 Judge Bob Wortham, 58th District Court, dismissed KTM Services without prejudice, court records show.
SembCorp filed a motion to dismiss on July 18, stating that it no longer wished to pursue its claims against the company.
According to the lawsuit, on Oct. 1 SembCorp leased 50 acres of land at 8498 1st Ave., Sabine Pass to KTM at the rate of $1,000 per day. Additionally, a $30,000 was to be paid at the signing of the lease.
"As of March 14, defendant has made no payments whatsoever to plaintiff on the lease or deposit," the suit states. "On that date, $165,000 was due on the lease, and the lease was terminated pursuant to the terms of the lease."
In its suit, SembCorp alleged KTM breached its contract.
