Dealership sued for not using recommended oil

Groves resident James Cross has filed a suit against the Allen Samuels Auto Group, alleging the dealership didn't use the recommended oil when they changed his truck's lubricants two years ago.

The suit was filed July 27 in Jefferson County District Court.

Court records show that sometime in August 2009, Cross brought his 2004 Dodge Ram to the Allen Samuels dealership in Port Arthur for an oil change.

"Due to carelessness/negligence of defendants' employees, they failed to use the required/recommended synthetic oil and as a result caused extensive and permanent damage to plaintiff's engine," the suit states.

Under the Texas Deceptive Trade Practices Act, Cross is suing for actual, consequential and exemplary damages.

Beaumont attorney Rocky Lawdermilk represents him.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
