Two Nederland residents allege they sustained severe and permanent injuries to their necks and backs after a driver rear-ended the vehicle in which they were riding.
Monica Turnipseed and Ellyn Turnipseed claim Monica Turnipseed was driving a vehicle west in the 3000 block of U.S. Highway 69 at its intersection with the 4600 block of S. Fourth Street in Beaumont on June 21, 2010, when the accident occurred.
Defendant West Wendell Holloway, who drove a vehicle for defendant Ward Construction, failed to control his speed and slammed into the rear of Monica Turnipseed's vehicle, according to the complaint filed July 21 in Jefferson County District Court.
At the time of the collision, Elllyn Turnipseed rode as a passenger in Monica Turipseed's vehicle, the suit states.
In addition to her neck and back injuries, Monica Turnipseed sustained injuries to her shoulder blades and right foot and suffered from dizziness following the collision, the complaint says. Monica Turnipseed also claims she sustained ringing in her ears and headaches while Ellyn Turnipseed alleges she sustained head injuries and suffered from headaches.
Both women incurred medical costs; experienced extreme physical pain, physical impairment, physical disfigurement, suffering and mental anguish; and lost their enjoyment of life, according to their complaint.
Holloway negligently failed to control his speed, failed to maintain control of his vehicle, failed to keep a proper lookout, failed to timely apply his brakes and drove negligently, the suit states.
In their complaint, the Turnipseeds request an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.
