Black Lab attack leads to lawsuit

GALVESTON - Claiming she was the victim of a dog attack at a house in Dickinson six months ago, Joyce Keimig has filed a lawsuit.

Keimig was at the residence of Jane Harris last Feb. 1 when a dog belonging to Catherine Holmes attacked her, a lawsuit filed July 22 in Galveston County District Court says.

The original complaint states a large black Labrador retriever charged and knocked the plaintiff down just as she rang the doorbell.

Keimig claims the women "knew the dog was aggressive and dangerous," making Harris and Holmes strictly liable for her injuries.

"The defendants' wrongful conduct caused the plaintiff's injury."

Keimig insists she did nothing to cause the alleged damages and wholly blames Harris and Holmes for the pet's behavior.

"The defendants owned or possessed the animal; the animal had dangerous propensities abnormal to its class," the suit says.

"The defendants knew or had reason to know the animal had dangerous propensities and the animal's dangerous propensities were the producing cause of legal damages to the plaintiff."

Consequently, the complainant seeks unspecified monetary damages.

Attorney Rich Melendez of Houston is representing Keimig, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
