Radiology tech, 68, sues after losing job for not being able to use equipment

LUFKIN - A 68-year-old radiology technician has filed an age discrimination lawsuit against her employer after she was allegedly fired for not being able to use the equipment.

Jessie Garrett filed suit against Shelby Medical Holdings, doing business as Shelby Regional Medical Center Hospital, on Aug. 19 in the Eastern District of Texas, Lufkin Division.

Garrett worked on and off for the defendant for more than 40 years, with the most recent position as a radiology technician beginning in 1989. She states the defendant made complaints that she was "too slow," "forgetful," and "not comprehending well."

She was terminated from her position in March, allegedly for not being able to use the equipment.

However, Garrett states her age was a determining factor in the medical center's decision to terminate her.

The defendant is accused of knowingly and willfully discriminating against Garrett on the basis of her age in violation of the Age in Discrimination in Employment Act.

The plaintiff is seeking damages for back pay, reinstatement, front pay, liquidated damages, attorney's fees and costs.

Garrett is represented by Lufkin attorney Charles R. Dendy.
