Plaintiff claiming withheld income files motion to nonsuit

GALVESTON - A plaintiff in a $7 million lawsuit alleging wrongfully withheld income seeks to nonsuit his case.

Gerald Krunop entered a motion to voluntarily nonsuit Falcon Interests Realty Corp. and co-defendants Arnold Tauch and Jack Moss on Aug. 22 before the Galveston County 212th District Court.

Krunop filed suit on Oct. 4, 2010, claiming he was never compensated for performing real estate-related services.

He asserted that he worked to secure various loans and other financial opportunities in the amount of $20 million for the defendant to develop a couple of tracts of real property in Galveston County from December 2009 to September 2010, but did not receive income.

The original petition stated that the plaintiff's work gave the defendant benefits which enabled the latter to avoid paying monthly note obligations as well as accept or decline the $20 million funding proposal in question, stating the respondent turned down all proposals.

The defendant reportedly ceased all dealings with all financiers provided by the plaintiff on Sept. 16, 2010.

An original answer countering Krunop's allegations was submitted Nov. 15, 2010.

The three-page document argues "that this is not an action involving title to real property, the establishment of an interest in real property or the enforcement of an encumbrance against real property."
