Safety supervisor sues Lindale company for failing to pay overtime wages

MARSHALL - A safety supervisor for a Lindale company has filed a lawsuit that claims his employer violated the Fair Labor Standards Act by failing to pay overtime wages.

Azmi Abdelmajid, individually and on behalf of all others similarly situated, filed suit against Enersafe LLC on Oct. 5 in the Eastern District of Texas, Marshall Division.

Abdelmajid was hired by the defendant in April to work as a safety supervisor at Enersafe's facility location in Lindale. In his complaint, Abdelmajid alleges that he was not paid overtime wages for all hours worked in excess of 40 hours in a work week. Abdelmajid states that there are numerous safety supervisors who are not paid for all overtime hours.

The defendant is accused of violating the Fair Labor Standards Act by failing to pay Abdelmajid and similarly situated employees overtime wages.

Abdelmajid is seeking an award of unpaid wages, liquidated damages, court costs and attorney's fees.

The plaintiff is represented by Tyler attorney William S. Hommel, Jr. A jury trial is requested.

U.S. District Judge David Folsom is assigned to the case.
