A Port Arthur woman claims her minor son sustained a contusion to his forehead and headaches after the driver of a vehicle caused the automobile to flip.
Brenda Flugence filed a lawsuit Oct. 6 in Jefferson County District Court against Adrian Harris and Jimmie Crout.
In her complaint, Flugence alleges her minor son, identified only as M. Montgomery, was riding in a vehicle Harris drove on U.S. 69 on Nov. 14, 2009. Suddenly, Harris lost control of the vehicle, causing it to flip, according to the complaint.
Because of the collision, Montgomery sustained back and left elbow pain and experienced a diminished earning capacity, the suit states. In addition, he experienced physical impairment, mental anguish, physical pain and disfigurement, the complaint says.
Flugence blames Harris for causing the collision, saying he negligently failed to keep a proper lookout, failed to timely apply his brakes and drove without considering the safety of others.
In her complaint, Flugence seeks an unspecified judgment, plus interest, costs and other relief the court deems just.
Jonathan C. Juhan and J.J. Bragg of Beaumont will be representing her.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
