LUFKIN - Workers for a Carthage business have filed a class action which alleges they were not paid for the hours they worked in excess of 40 per workweek.
Claiming violations of the Fair Labor Standards Act, Kevin Johnson, Brad Smith and Tommy Higgins, individually and on behalf of others similarly situated, filed suit against Heckmann Water Resources Inc., Complete Vacuum and Rental and Steven Kent Jr. on Oct. 14 in the Eastern District of Texas, Lufkin Division.
The lawsuit is filed as an "opt-in" class action which will represent all worked employed by the defendants, who worked in excess of 40 hours in any workweek since Oct. 14, 2008, and who did not receive overtime wages at one-and-one-half times their regular hourly rate for all hours worked over 40 in any workweek.
The former employees are asking for an award of unpaid or underpaid overtime, plus liquidated damages, interest, attorney's fees and court costs.
