SHERMAN - A disabled man has filed a discrimination suit against a Dallas restaurant for non-compliance with accessibility laws.
Lee K. Burrell, a double amputee, filed suit against Private Restaurant Properties and Carrabba's Italian Grill on Oct. 10 in the Eastern District of Texas, Sherman Division.
According to the lawsuit, the restaurant was built within the past 10 years with numerous architectural barriers that are in direct violation of the Texas Accessibility Standards or the Texas Architectural Barrier's Act. Burrell states that the restaurant does not have booth seating that is accessible and no accessible seating in the bar area.
The defendant is accused of violating the Americans with Disabilities Act for failing to accommodate, new construction and discrimination.
The plaintiff is asking the Court for an order to stop the defendants from discriminating against Burrell and for an award of statutory damages, attorney's fees and court costs.
Burrell is represented by Addison attorney Palmer D. Bailey. A jury trial is requested.
U.S. District Judge Michael H. Schneider is assigned to the case.
