Collection agency sued for contacting wrong person about debt

A Port Arthur resident has filed a lawsuit against a debt collection agency for repeatedly calling her about someone else's debt.

Pamela J. Webb filed suit against Global Acceptance Credit Co. on Oct. 13 in the Eastern District of Texas, Beaumont Division.

The defendant allegedly attempted to collect someone else's debt by calling Webb's residential telephone, according to the lawsuit.

Webb claims she informed Global that the debtor did not reside with her or that she did not know the debtor, the defendant continued to place calls to Webb regarding the debt. The suit alleges the debt collector would accuse Webb she was not being truthful.

The defendant is accused of violating the Fair Debt Collection Practices Act by using abusive and profane language, causing Webb's phone to ring repeatedly with the intent to annoy and for employing false and deceptive means to collect a debt.

The defendant is also accused of invasion of privacy by intrusion into private affairs by hounding the plaintiff and violations of the Telephone Consumer Protection Act.

The plaintiff is seeking an award of actual damages for humiliation, anger, anxiety, emotional distress, fear, frustration, embarrassment, statutory damages, punitive damages, court costs and attorney's fees.

Webb is represented by Jody B. Burton of Lemberg & Associates in Dallas.

A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
