SHERMAN - A 63-year-old woman has filed an age discrimination lawsuit against her employer after she was allegedly terminated for sharing her password with a co-worker.
Susan M. Ogle filed suit against TIAA-CREF, individual and Institutional Services on Oct. 19 in the Eastern District of Texas, Sherman Division.
According to the suit, Ogle was informed on June 8 that she was going to be terminated for sharing her computer password with another employee. Instead of having the termination on her record, she chose to resign.
At the time of her termination, she was 63 years old. She states that numerous younger employees shared and accessed computer passwords but were not terminated, according to the suit.
The defendants are accused of violating the Age in Discrimination in Employment Act and violating the Texas Labor Code.
The plaintiff is seeking damages for lost wages and benefits, liquidated damages, compensatory and punitive damages, attorney's fees, front pay, court costs, interest, and mental anguish.
A jury trial is requested.
Ogle is represented by Dallas attorney Bill Lamoreaux.
U.S. District Judge Michael H. Schneider is assigned to the case.
