USAA sued for reneging on auto claim settlement

Harris County resident Gilroy Guerra has filed suit against USAA County Mutual Insurance, alleging the company reneged on a settlement offer for an October 2009 auto crash.

The suit was filed Oct. 21 in Jefferson County District Court.

According to the lawsuit, on Oct. 9, 2009, Guerra was in an auto collision with an individual insured by USAA.

Guerra made a claim and on Dec. 27, 2010, USAA made an offer to settle the claim for $3,000. On Oct. 10 he accepted the claim.

However, the following day Guerra received a letter from USAA stating that the statue of limitations had passed and the company would not be paying the claim, the suit states.

The suit accuses USAA of fraud and breach of contract.

The plaintiff is suing for actual and exemplary damages.

Beaumont attorney Jeffrey Roebuck of Roebuck, Thomas, Roebuck & Adams represents him.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
