League City resident blamed for Houston wreck

GALVESTON - Harris County residents Shawn Griffin and Tiffany Dixon claim League City resident Lyndsy Urquiaga caused a two-vehicle accident between the three of them two years ago, recent court documents say.

According to a lawsuit filed Oct. 12 in Galveston County Court at Law No. 1, Urquiaga was on a cell phone when she drove a GMC Yukon into Griffin's Toyota Corolla at the intersection of Chimney Rock Road and Westheimer Road in Houston on Oct. 13, 2009.

Dixon was Griffin's passenger.

The original petition shows that the plaintiffs were proceeding to turn left on a green light when Urquiaga reportedly failed to turn within the proper lane and struck them.

"In the collision, the plaintiff's vehicle was thrown to the side, striking and bouncing from the curb area," the suit says.

"As a result of the collision, the plaintiffs were violently thrown within the vehicle."

The complainants say Urquiaga continued on her way instead of stopping to provide information or help.

She is faulted for failing to maintain a single lane of traffic, failing to control the speed of her vehicle, failing to maintain a proper lookout, failing to obey a stoplight, failing to turn the vehicle to avoid a collision and failing to sound the horn.

Sean Tracy, also of League City, joins Urquiaga as a co-defendant because he negligently entrusted the Yukon to her, the suit says.

The plaintiffs consequently seek unspecified monetary damages.

They are represented by attorney Shelly Winn of Houston.

The case has been assigned to Galveston County Court at Law No. 1 Judge John Grady.
