Uninsured motorist claim filed against Old American Insurance

Following a hit and run, Murrel Merchant made a claim for uninsured motorist benefits with her carrier, Old American County Mutual Fire Insurance Co.

Alleging she is owed benefits for her mental anguish, medical expenses, pain and impairment, Merchant filed suit against Old American Insurance on Oct. 28 in Jefferson County District Court.

According to the lawsuit, on Oct. 8, 2009, Merchant was in an automobile collision with a hit-and-run driver.

Following the incident, Merchant made a claim for uninsured motorist benefits with Old American Insurance.

"The injuries and property damage sustained by plaintiff were not the result of intentional acts, but were accidental and caused by the negligence of the uninsured driver," the suit states. "Plaintiff hereby seeks recovery for injuries and property damage under uninsured coverage."

Beaumont attorney Chris Portner of Portner Bond represents her.

Judge Bob Wortham, 58th District Court, is assigned to the case.
