After more than seven years of litigation, a suit filed by a plaintiff claiming a motorist struck her while she was riding her bike has been dismissed.
A court official told the Southeast Texas Record that Judge Gary Sanderson, 60th District Court, dismissed the case on Monday because plaintiff Karen Gifford did not show up for her trial.
Gifford filed suit against Virgil and Mary Chaison on May 27, 2004, in Jefferson County District Court.
According to her original petition, on May 29, 2002, Gifford was out riding her bicycle when Virgil Chaison, who was driving a vehicle owned by Mary Chaison, allegedly failed to yield the right of way and struck Gifford.
The case was set to go to trial on Nov. 7.
Gifford was seeking damages for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
