Port Arthur wreck leads to lawsuit

A woman has filed suit against the driver who she claims struck her vehicle, causing her to sustain injuries.

Bertha Hartwell claims she was driving at the intersection of 15th Street and Second Avenue in Port Arthur on Dec. 1, 2009, when defendant Jodie Lea Rogers struck her vehicle.

Because of the collision, Hartwell sustained bodily injuries; incurred medical costs; and experienced physical pain, mental anguish and physical impairment, according to the complaint filed Dec. 1 in Jefferson County District Court.

Hartwell says the collision was caused by the negligence of Rogers, but does not specify any more reasons for the collision in her complaint.

Hartwell is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the legal rate, costs and other relief to which she may be entitled.

John A. Carwile of The Law Offices of John A. Carwile will be representing her.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.

Case No. E191-408
