Plano hardware store sued for displaying credit card expiration numbers on receipts

SHERMAN - A Plano hardware store is being sued for violating the Fair and Accurate Credit Transaction Act by allegedly displaying credit card expiration numbers on customers' receipts.

Donald C. Harvey filed the class action lawsuit against Elliott's Hardware Inc. on Jan. 16 in the Eastern District of Texas, Sherman Division.

Harvey states that he made a purchase with his personal credit card at Elliot's Hardware in Plano on Dec. 12 and his paper receipt displayed the expiration date of the card.

Under FACTA's requirements, ATM and point of sale terminals are not to generate receipts that contain more than the last five digits of the card number and are not to contain expiration dates.

The plaintiff is asking the court for an award of statutory damages, punitive damages, court costs and attorney's fees.

Harvey is represented by Emil Lippe Jr. of Lippe & Associates in Dallas and R. Bruce Carlson of Carlson Lynch Ltd. in Sewickley, Penn.

A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
